By accessing or using ProCaller ("Service"), operated by SherdeepAI ("we," "our," or "us"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not use the Service.

ProCaller enables you to:
- Acquire virtual domain numbers (not actual mobile numbers)
- Create AI-powered customer support agents
- Automate responses to calls and messages via the ProCaller app
- View conversation summaries and analytics
- Manage customer communications efficiently
- No Audio Recording: We do NOT record or store audio from calls
- No Traditional Phone Service: Domain numbers only work within ProCaller app
- No Actual Mobile Numbers: These are virtual identifiers only
- No Response Guarantees: AI responses are automated and may vary in quality
- Service availability subject to maintenance and technical issues
- Features may be modified or discontinued
- We strive for high uptime but don't guarantee uninterrupted service
- Beta features provided "as-is" without warranties
- You must register with a valid email address
- Provide accurate and complete information
- Keep your account information current
- One account per person or business entity
You are responsible for:
- Maintaining confidentiality of your credentials
- All activities under your account
- Immediately notifying us of unauthorized access
- Using strong passwords and security features
We are NOT liable for losses from unauthorized account use.
- Business accounts may require verification documentation
- We may verify your identity and information
- Verified status may be revoked if information is false
- Verification may be required for certain features
- Domain numbers are virtual identifiers, not actual mobile numbers
- You acquire usage rights, not ownership
- Domain numbers work only within the ProCaller app ecosystem
- We retain all underlying infrastructure rights
You may use domain numbers for:
- Legitimate customer support
- Business communication and information sharing
- Automated responses to customer inquiries
- Personal use consistent with platform purposes
You may NOT use domain numbers for:
- Spam, harassment, or unsolicited communications
- Fraudulent, deceptive, or illegal activities
- Impersonating others
- Violating third-party rights
- Distributing malware or harmful content
- Circumventing platform security
- Any unlawful purpose
- Domain numbers have specified validity periods
- You must renew before expiration
- Expired domains may be reassigned to others
- We will send expiration reminders
- No refunds for expired unused domains
We may suspend or revoke domains if you:
- Violate these Terms
- Engage in prohibited activities
- Fail to comply with legal requirements
- Use domains for fraud or abuse
- Our AI uses Google Gemini paid/enterprise versions
- AI generates responses based on information you provide
- Response quality depends on your input data
- AI responses are automated and may contain errors
You are responsible for:
- Accuracy of information provided to the AI
- Appropriateness of AI-generated responses
- Monitoring AI interactions
- Compliance of responses with applicable laws
- Regularly updating information for current responses
- AI may occasionally generate incorrect responses
- We don't guarantee accuracy or appropriateness
- You should monitor and review AI interactions
- Critical decisions should not rely solely on AI
- We are not liable for AI-generated content errors
"Your Content" includes all information, data, and materials you provide to the platform, including business information, FAQs, and response templates.
You grant us a limited license to:
- Store and process your content
- Use it to provide AI-powered services
- Generate responses based on your content
- Display it to users who interact with your domain numbers
This license ends when you delete your content or account.
You represent that:
- You own or have rights to all content you provide
- Your content doesn't violate third-party rights
- Your content complies with applicable laws
- Your content doesn't contain prohibited material
You may NOT provide content that:
- Is illegal or promotes illegal activities
- Infringes intellectual property rights
- Contains malware or harmful code
- Is defamatory, obscene, or hateful
- Violates privacy rights
- Promotes violence or discrimination
- Is sexually explicit or exploits minors
- Contains confidential information without authorization
- We may (but aren't obligated to) monitor content
- We may remove content violating these Terms
- Repeated violations may result in account suspension
- We reserve the right to refuse service to anyone
- Domain numbers require payment for acquisition and renewal
- Fees displayed during purchase process
- All fees are in the currency specified
- Prices subject to change with notice
- Payments processed through third-party processors
- You must provide accurate payment information
- We don't store full payment card details
- You authorize charges for services purchased
- Domain Numbers: No refunds for expired unused domains
- Early Cancellation: Pro-rated refunds at our discretion
- Service Issues: Refunds considered case-by-case
- Fraudulent Purchases: No refunds for fraudulent transactions
You are responsible for all applicable taxes related to your use of the Service.
ProCaller, its logo, features, and content are owned by SherdeepAI and protected by intellectual property laws. You may not:
- Copy, modify, or distribute our content
- Use our trademarks without permission
- Reverse engineer the platform
- Create derivative works
You retain all rights to your original content. We claim no ownership over content you provide.
If you provide feedback or suggestions, we may use them without obligation or compensation to you.
Your use of ProCaller is also governed by our Privacy Policy, available at https://procaller.sherdeepai.com/privacy-policy

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- MERCHANTABILITY
- FITNESS FOR PARTICULAR PURPOSE
- NON-INFRINGEMENT
- ACCURACY OR RELIABILITY
We do NOT guarantee:
- Specific customer satisfaction outcomes
- AI response quality or accuracy
- Uninterrupted or error-free service
- Specific business results or revenue
We are not responsible for:
- Third-party service failures
- Third-party content or actions
- Third-party security breaches
- Integration issues with external services
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.
WE SHALL NOT BE LIABLE FOR:
- INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES
- LOST PROFITS OR REVENUE
- DATA LOSS
- BUSINESS INTERRUPTION
- LOSS OF GOODWILL
These limitations apply even if a remedy fails its essential purpose.
You agree to indemnify and hold harmless SherdeepAI, its affiliates, and personnel from any claims, damages, or expenses arising from:
- Your use of the Service
- Your content
- Your violation of these Terms
- Your violation of third-party rights
These Terms remain in effect while you use the Service.
You may terminate by:
- Closing your account via app settings
- Emailing rkverma@sherdeepai.com
- Account deletion has a 30-day grace period
We may suspend or terminate your account if:
- You violate these Terms
- You engage in fraudulent or illegal activities
- Required by law
- At our discretion with reasonable notice (except for violations)
Upon termination:
- Your access to the Service ends immediately
- Your domain numbers become inactive
- Data deletion follows our Privacy Policy (30-day grace period)
- Fees paid are non-refundable except as stated
- Sections that should survive termination remain in effect
These Terms are governed by the laws of India, without regard to conflict of law principles.
Before filing a claim, contact us at rkverma@sherdeepai.com to seek informal resolution. We'll attempt to resolve disputes amicably.
If informal resolution fails, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules, rather than in court.
You may pursue claims in small claims court if they qualify. We may seek injunctive relief in court for intellectual property or confidentiality violations.
These Terms and our Privacy Policy constitute the entire agreement between you and SherdeepAI.
If any provision is found unenforceable, the remaining provisions remain in full effect.
Our failure to enforce any right doesn't waive that right.
You may not assign these Terms. We may assign them to affiliates or in connection with a merger or sale.
We're not liable for delays or failures due to circumstances beyond our reasonable control.
